Stripe policies​

1. Legal Restrictions


Florida law, in line with federal regulations such as the Federal Trade Commission Act (FTC Act), prohibits any advertising practice that misleads the consumer.


This includes:


  • False or exaggerated claims about products or services.
  • Omission of relevant information that may change the consumer's perception of the product.
  • Use of "bait advertising" to attract consumers with no intention of complying with the advertised offers.


Consequences: Companies may face fines, legal sanctions or class action lawsuits for violating these regulations.


2. Personal Data Protection


Although Florida does not yet have a privacy law as robust as California's CCPA or the European GDPR, companies must follow regulations related to the collection and use of personal data.


This includes:


  • Obtain explicit consent from the user before collecting their data.
  • Provide clear notices about how data will be collected, used and stored.
  • Protect personal information from unauthorized access or leakage.


Consequences: In case of non-compliances, the company may face legal sanctions, lawsuits by users or reputational damage.


3. Copyright and Intellectual Property


It is crucial to respect copyrights when using content such as images, videos, music or text in marketing campaigns.


Key regulations:


  • The content must be licensed or have the necessary permissions.
  • Misuse of trademarks may result in infringement.


Consequences: May include copyright infringement lawsuits, financial penalties and removal of illegally used content.


4. Children's Advertising


Advertising to minors is strictly regulated. The laws seek to protect this vulnerable audience from manipulative practices or inappropriate content.


Restrictions:


  • Children's lack of experience or credulity cannot be exploited.
  • It is prohibited to promote products inappropriate for minors, such as alcoholic beverages or gambling.


Consequences: Companies may face additional restrictions and regulatory penalties for non-compliance.


5. Digital Advertising Regulations


Digital platforms have their own advertising policies, in addition to legal regulations:


  • Google and Facebook prohibit ads that promote certain products, such as weapons, drugs or sensationalist content.
  • The use of cookies and trackers is regulated; user consent is required to activate these tools.


Consequences: Ads may be blocked by the platforms and the company may be reported for malpractice.


6. Unfair Competition


The Florida Antitrust Act and federal laws regulate practices that seek to limit competition in the marketplace.


Prohibited practices:


  • Unfairly defaming the competition. 
  • Mislead the consumer by unfairly comparing products or services.


Consequences: Violations can lead to fines, lawsuits and regulatory investigations.


7. Advertising of Regulated Products


The promotion of certain products, such as tobacco, alcohol, drugs or gambling, is regulated by state and federal laws.


Requirements:


  • Respect age restrictions for the target audience.
  • Include mandatory legal warnings (e.g., risks associated with tobacco or alcohol consumption).


Consequences: Failure to comply with these regulations may result in heavy fines, campaign bans or loss of licenses.


8. Local and Federal Compliance


In addition to Florida state laws, businesses must comply with federal regulations such as:


  • Truth in Advertising Laws, which require accuracy and transparency.
  • CAN-SPAM Act, which regulates the sending of advertising e-mails.


Consequences: Violations of these regulations may lead to financial penalties and restrictions on the company's operations.
